Hawaii Bill to Ban Most Aftermarket Exhaust Systems

Legislation (H.B. 2209) to require official inspection stations to test vehicles to determine if their exhaust systems “emit noise noticeably greater than that emitted by the vehicle as equipped from the factory” was introduced in Hawaii. Under the bill, inspection stations found to have issued a certificate of inspection in violation of this provision could be fined up to $1,000 and have their inspection permits suspended or revoked.

We Urge You to Contact Members of the Hawaii House Transportation Committee (List Below) Immediately to Oppose H.B. 2209
  • H.B. 2209 provides no test by which vehicles could be tested. Many states have established noise limits for modified exhaust systems based on an easy to administer objective test standard (SAE J1169) to a fair noise limit of 95-decibels.
  • H.B. 2209 would force inspectors to fail vehicles for violation of an unspecified test.
  • H.B. 2209 does not provide inspection stations with decibel readings on factory-installed exhaust systems.
  • H.B. 2209 ignores the fact that aftermarket exhaust systems are designed to make vehicles run more efficiently without increasing emissions.
  • H.B. 2209 would make it impossible for hobbyists to replace factory exhaust systems.

might actually have to go down to the Leg with my new boss to go lobbying during session, will try and catch the ones i don't already know in between hearings.

I can just imagine how they propose to ensure accurate testing of aftermarket exhaust systems. People will complain because the added cost to perform such a test, plus the cost of the inspection , will not be economically reasonable.

didn't they try to introduce a bill like this a couple of years ago? i don't think it made it very far, but you never know... better to be proactive than just hope it gets shot down for being ill-written.

i'm not too up on Recon these days- never really needed to deal with it before. i know a little of the history and intent, and lois posted up on some of the newer changes but that's about the limit of my knowledge.

Is there another bill regarding Recon going on?

Rep. Scott Nishimoto and Rep. Scott Saiki sponsored it.

Passed first reading and is now in TRN Committee. Has some edits and revisions, but the intent is the same - no aftermarket mufflers that may increase the noise emissions.

Last time, lots of the old time hot rodders, HD riders, and speed/muffler shop owners got involved and shot it down. Hopefully it happens again this time as well.

I'm guessing that this bill was introduced just so these lawmakers will look good to their constituents and pad their bills introduced count (kinda like post whoring). It's an election year thing - just gotta look like you care and make a show of introducing bills that you know have a snowball's chance...

Reps. Nishimoto and Saiki are actually really nice guys, and quite personable and reasonable. I don't think I've ever sat down and talked cars with them, though so don't know what their experiences with modding cars is. Honestly can't picture either of them driving modded cars, but then people say that about me all the time too.

For all the other good things they've done, I'm giving them the benefit of the doubt and figuring that they introduced this to address noise issues in their neighborhoods and didn't really think it through how it affects everything from enthusiasts to businesses.

I see via edits that other people are getting their hands on it, too.

Hopefully it doesn't have a companion bill that crosses over, or you'll have two things to watch.

Modifying my car is a form of art and it is how I express myself. This new law directly infringes on my first amendment rights of free speech and expression. So...not exactly sure how they plan on passing this law seeing as how it's unconstitutional.

It looks like the bill now says ALL motor vehicles (which I assume includes hot rods and classics) and motor scooters.

The description is too vague and basically says ANY change that makes it noticeably louder will result in a fine and will not be allowed.

Some further thoughts:
  1. The economic effect would be huge. It will hurt local mom and pop businesses such as Exhaust Systems Hawaii, Ron's Performance, and other aftermarket companies.
  2. It will hurt our relationship with national and international businesses that import their product here as well as their business.
  3. It will lessen our freedoms to modify our vehicles to our own personal likes and it will affect thousands of aftermarket enthusisasts while costing them thousands of dollars to retrofit their vehicles to standard to become legal.
  4. There will most likely be a considerable cost factor to consider while implementing this law due to increased training,monitoring, and equipment plus the need for the stock decibel level for every car manufactured and their different makes, all while the act of enforcing it will be nigh impossible.
  5. It's a crap idea.

if the local dealerships get wind of this, they will lobby hard for it.

they can say that even midas replacement mufflers will be "too loud" so they should stick with OEM equipment for OEM sound levels and compliance, then charge whatever they want (to their already overinflated prices).

hmm.... going down that road, i wonder who actually was the inspiration behind this bill? i don't think it would be one of major manufacturers, but if it was somebody connected to a dealership, that would be interesting (to say the least).
